Contest Rules

OFFICIAL RULES:

The Bike Park Relapses – A Race for the Mind Competition (the “Competition”) will be run in accordance with these Rules. Participants must comply with these Rules, and will be deemed to have received and understood these Rules by participating in Competition. Whistler Blackcomb may, at its discretion, terminate, suspend and/or amend the Competition and these Rules.

ELIGIBILITY:

The Competition is open to residents of Canada (excluding Quebec), the United States of America, the United Kingdom, and New Zealand who are 13 years of age or older. Employees, representatives and agents of Whistler Blackcomb and its affiliates, prize suppliers, advertising and promotion agencies and members of the immediate family (parent, child, sibling and spouses) of all such persons as well as those with whom they are domiciled are not eligible to enter. Void where prohibited by law.

SPONSOR:

The Sponsor of the Competition is Whistler Mountain Bike Park, with an address at 4545 Blackcomb Way, Whistler BC V0N 1B4 Canada.

COMPETITION PERIOD:

The Competition will run from 12:01 am (PST) on April 20, 2017 to 11:59 pm (PST) on May 11, 2017 (“Competition Period”)

HOW TO PLAY:

No purchase necessary. No fees are payable.

To enter, visit bike.whistlerblackcomb.com during the Competition Period and follow the link to the Competition microsite. From there, login through your Facebook profile and follow the instructions to participate in the Competition. Participants will have one attempt only to complete the Competition.

Once the participant starts participation in the Competition, he or she will be provided with 10 photos, in random order, of different trails and features of the Whistler Mountain Bike Park. The participant will be asked to identify the trail or feature in the photo by selecting one of 6 possible answers from a dropdown menu. One of the 6 options in the dropdown menu will be the correct answer. The participant’s race to identify the features or trails in each of the 10 photos displayed will be timed. Once the participant starts the race to identify the feature or trails as part of the Competition, there will be no means to pause or stop the race.

Participants will not be shown which questions they answered correctly or incorrectly.

Participation is limited to one entry per person and one entry per Facebook account.

DETERMINATION OF WINNER:

Subject to these Rules, the participant in the Competition who answers correctly the most questions in the least amount of time will be the winner. As an example, if 2 people score 10/10 questions correctly, the participant who completed the questions in the least amount of time would be the winner. In the event of a tie (for example, 10/10 questions answered correctly in the exact same amount of time) at the end of the Competition Period, the winner will be determined by a random draw by a representative of Whistler Blackcomb at 4545 Blackcomb Way, Whistler, BC on or about May 12, 2017 from among such tied participants in order to select one participant for the prize. Participants do not have to be present at the draw in order to qualify to win.

The number of questions answered correctly by a participant in the Competition, the participant’s time for doing so, and the determination of the winner of the Competition will be based solely on Whistler Blackcomb’s records. Whistler Blackcomb's records and decisions with respect to the Competition are final and binding.

LEADER BOARD AND WINNER:

Throughout the Competition Period, Whistler Blackcomb may publish on the Competition website a leader board with the names of participants in the Competition who are in the top 10 standings of all participants. Whistler Blackcomb may also highlight who is in the “hot seat” – first place in the standings – during the Competition Period and share this on social media.

The name of the winner will be published on the Competition website.

PRIZE:

One 2017 Whistler Mountain Bike Park season pass.

Prize conditions:
The pass may have additional rules that apply or conditions that must be met in order to use or receive it. The Prize winner must agree to such rules and conditions, and acknowledges that if such conditions are not met, the Prize may not be awarded to winner.

The retail value of the Prize is $750.00 CDN before tax. Any difference between stated retail value and actual prize will not be awarded.

WINNING AND NOTIFICATION: The participant determined to be the winner of the Prize will be notified through their Facebook account at the end of the Competition Period, on or about May 12, 2017.

Before being declared the winner of the prize, the selected participant will be required to sign and return to Whistler Blackcomb within the period indicated thereon a declaration and release form: confirming compliance with these Rules and acceptance of the applicable prize as offered; acknowledging the non-responsibility of Whistler Blackcomb and its affiliates, and their respective employees, directors, officers, representatives and agents with respect to liability, damage, injuries, accident, loss or misfortune relating to (i) participation in the Competition or any related activity, and (ii) acceptance, possession, use or misuse of the applicable prize or any component thereof, to the extent permitted by law; and acknowledging the right of Whistler Blackcomb and its affiliates, and their respective employees, directors, officers, representatives and agents to collect and publish or broadcast the winner’s likeness, name, address, voice and statements made in relation to the Competition in any publicity, promotion or advertisement carried out by Whistler Blackcomb or its authorized agents worldwide without further notice or compensation, other than the prize offered.

In the event that a selected participant is not eligible to claim the Prize or is unwilling or unable to comply with these Rules, or Whistler Blackcomb is unable to contact the participant within 14 days, his/her entry will be disqualified and the participant with the next highest score of correct answers in the least amount of time will be selected as the winner, until such time that the prize has been successfully awarded.

Winner is solely responsible for the reporting and payment of any applicable taxes on or associated with the acceptance and use of the Prize. Winner may waive his/her right to receive a prize or any component thereof. The Prize is non-transferable, non-exchangeable, and non-refundable, has no cash value and must be accepted by the winner as awarded. Upon selection of winning participant, arrangements will be made for delivery or pick up of the Prize. The Prize will be forfeited if the winner is not able to redeem it during the time period designated by Whistler Blackcomb. Whistler Blackcomb reserves the right to substitute the Prize with a prize of equal or greater value in the event that the Prize is unavailable due to circumstances beyond their control.

Privacy Policy

PRIVACY:

By entering the Competition, entrants consent to the collection, use and disclosure of their personal information for the purposes of administering the Competition and for the purposes of understanding the needs and preferences of individuals or to develop, enhance, market and/or provide products and services, as more particularly described in the Whistler Blackcomb privacy policy. Whistler Blackcomb will collect, use and disclose such personal information in accordance with these Rules and with the Whistler Blackcomb privacy policy (which can be found at http://www.whistlerblackcomb.com/about-us/privacy-policy).

RELEASE:

By entering the Competition, entrants acknowledge that they are releasing Whistler Blackcomb, their respective directors, officers, employees, representatives, agents, affiliates, prize suppliers, advertising and promotion agencies (collectively, the “Releasees”) from any liability whatsoever for any claims, costs, injuries, losses, liability or damages of any kind arising out of or in connection with (i) participation in the Competition or any related activity, or (ii) the acceptance, possession, use or misuse of a prize or any component thereof, (including, without limitation, those related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light), to the extent permitted by law. By entering the Competition, entrants also agree to fully indemnify the Releasees and hold each of them harmless from any and all claims, costs, losses, liability or damages of any kind arising out of or in connection with (i) participation in the Competition or any related activity, or (ii) the acceptance, possession, use or misuse of a prize or any component thereof, by any third party. For UK residents: Notwithstanding anything to the contrary in these Rules, where the entrant resides in the UK and accepts these Rules from the UK, the exemptions and limitations of liability set out in these Rules shall not operate to exclude or restrict any person’s liability for death or personal injury resulting from such person’s negligence, nor to exempt or restrict a person’s liability for fraud or fraudulent misrepresentation, or for any liability that cannot be limited or excluded by law.

The winner acknowledges that the Releasees are not responsible for: (a) any problems or technical malfunction of any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any entry, team selection or change to be received by Whistler Blackcomb on account of technical problems or traffic congestion on the Internet or any website, or any combination thereof, including any injury or damage to an entrant’s or any other person’s computer, related to or resulting from playing or downloading materials in this Competition including the recording of game results; (b) any incomplete or inaccurate information, whether caused by the website users or by any equipment or programming associated with or utilized in the Competition, or by any technical or human error which may occur in the processing of entries; or (c) the theft, destruction or unauthorized access to, or alteration of, entries or the Competition website. Whistler Blackcomb reserves the right, in its sole discretion, to cancel, modify or suspend the Competition should a virus or bug or other cause beyond the reasonable control of Whistler Blackcomb corrupt the security or proper administration of the Competition. Any attempt to deliberately damage any website or to undermine the legitimate operation of the Competition is a violation of criminal and civil laws, and should such an attempt be made, Whistler Blackcomb reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Whistler Blackcomb reserves the right to forbid the framing of any of the contents of the Competition website and, in their sole discretion, to disqualify any individual who tampers with the entry or Competition process.

All entries become the property of Whistler Blackcomb and will not be returned. If the identity of a participant is disputed, the authorized account holder of the Facebook account used at the time of entry will be deemed to be the participant. A selected participant may be required to provide proof that he/she is the authorized account holder of the Facebook account associated with the selected entry. All entries must be submitted from a valid Facebook account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid online entry in the Competition will be the server(s) of Whistler Blackcomb.

All forms of participation or entry into the Competition that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of these Rules may be disqualified by Whistler Blackcomb. Whistler Blackcomb takes no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for typographical, production or other errors. Whistler Blackcomb is not responsible for any errors or omissions in printing or advertising the Competition or in these Rules.

Entrants acknowledge that the Competition is sponsored by Whistler Blackcomb. The Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants acknowledge that by entering the Competition they are providing their information to Whistler Blackcomb and not to Facebook.

DISPUTES:

You agree that any and all disputes, claims and causes of action arising out of, or connected with, the Competition, any prize awarded or any use of any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the province of British Columbia, Canada to the extent permitted by law. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, your rights and obligations, or the rights and obligations of Whistler Blackcomb in connection with the Competition, any prize awarded or any use of any prize awarded, shall be governed by, and construed in accordance with, the laws of the province of British Columbia, Canada, without giving effect to any choice of law or conflict of law rules that would cause the application of the laws of any jurisdiction other than the province of British Columbia, Canada.
